Terms of Use for Ocumi

Scope

Ocumi is provided by Jeremiah Stüve, Lomerstraße 69, 22047 Hamburg, Germany. Ocumi is distributed through the Apple App Store. Use of the app is governed by Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms supplement it. Where they conflict, Apple's licence agreement prevails.

Use

You may use Ocumi for personal, non-commercial purposes. You must be at least 4 years old. You may not decompile, modify or misuse the app.

Important notice

Ocumi gives hints about devices, not proof. False alarms are possible, and not every device is found. A hint concerns a device, never a person.

What the app is – and what it isn't

Ocumi gives hints about devices nearby: devices that send Bluetooth signals like smart glasses or trackers, and devices on your Wi-Fi that offer video services. It also offers a search aid for lens reflections. The app is not a measuring instrument and not a professional surveillance sweep.

The page “What Ocumi can do” in the app describes in detail what the app can and cannot do. A result without findings does not mean that no devices are present.

• False alarms are possible, for example from VR headsets or other devices made by the same manufacturer.
• Not every device is found: devices that are switched off or not transmitting, cameras without radio, on another network or on mobile data stay invisible.
• A hint does not tell whether anything is being recorded, nor who carries a device.

Responsible use

The app does not replace legal advice, advice from support services or a thorough search by professionals.

• A hint concerns a device, never a person. Do not accuse anyone based on a hint. Wrongly accusing others of covert recording can be a criminal offence (for example §§ 185 to 187 of the German Criminal Code).
• Wearing smart glasses is not prohibited just because the app shows them.
• Do not use the app to watch, follow, harass or expose other people, or to probe other people's devices.
• If you feel uncomfortable, keep your distance or ask politely. In danger, contact the police or emergency services (112 in the EU). If you find a hidden camera in accommodation, do not tamper with it and contact the police.

Free features and Pro

Live radar, AirTag search, network check and lens reflection search are free and without ads. Pro unlocks more: the background watch for trackers with a standardised service identifier, the history and the PDF report. The app shows exactly what Pro includes and what it costs before you buy; the price stated by the App Store in your currency applies.

Pro is available as a yearly subscription, a monthly subscription and a one-time purchase without a term (“Lifetime”). The one-time purchase is not a subscription and does not renew.

Purchases and subscriptions are concluded and billed through the Apple App Store. Apple is the payment processor, and Apple's terms apply, including for refunds (reportaproblem.apple.com) and any right of withdrawal.

Pro is tied to your Apple ID and can be shared with your family through Family Sharing. After reinstalling or on a new device, recover it with “Restore purchases”. If you bought the one-time purchase while a subscription is still running, please cancel the subscription yourself; Apple does not end it automatically. I do not offer business or volume licences.

Limits of iOS

Some features depend on what iOS allows. In the background, only trackers with a standardised service identifier can be detected; smart glasses and AirTags cannot. For AirTags, the tracker alerts built into iOS remain responsible. If Apple changes how iOS behaves, the scope of individual features may change.

Subscriptions

The following applies to Ocumi Pro subscriptions:

• The term is one year or one month, depending on your choice.
• Payment is charged to your Apple account when you confirm the purchase.
• The subscription renews automatically for the same term unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the end of the period.
• You manage and cancel subscriptions in your Apple account settings (Settings › your name › Subscriptions) or in the app under Settings. After cancelling, Pro stays active until the end of the paid period.
• Free trial: if the app shows a free trial for the yearly subscription (7 days), the subscription costs nothing during the trial. If you do not cancel at least 24 hours before it ends, the paid yearly subscription begins. The trial is available once per Apple account. Any unused part of a trial is forfeited when you buy a subscription.
• Apple notifies you of price changes according to its rules.

Availability and changes

I keep developing Ocumi and may change, add or discontinue features. There is no entitlement to a particular feature or uninterrupted availability, except where paid features are concerned.

Liability

I am liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where I have given a guarantee. For slight negligence I am only liable for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper use of the app possible in the first place and on whose compliance you may regularly rely), limited to foreseeable, typical damage. Statutory warranty rights of consumers remain unaffected.

I do not warrant that the app finds all devices around you. A missing hint is no guarantee that you are not being recorded or tracked.

Governing law

German law applies. Mandatory consumer protection provisions of the country where you habitually reside remain unaffected. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hamburg. I am neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
